Release, Waiver of Liability, Indemnification, and Media Release Agreement

By checking the box, I agree to the terms of this Release, Waiver of Liability, Indemnification, and Media Release Agreement (“Agreement”) as a condition of participation in any and all programs, events, or activities organized or sponsored by Danville Discovery Camp.

I represent that I am the parent or legal guardian of the minor child(ren) I am enrolling. I acknowledge that I have the legal authority to enter into this Agreement on their behalf.

1. Assumption of Risk and Voluntary Participation

By enrolling my child(ren) and allowing their participation in Danville Discovery Camp, I acknowledge and fully understand that there are inherent risks associated with participation in recreational, educational, and physical activities, including but not limited to accidental injury, illness, allergic reaction, property damage, or other unforeseen incidents.

I voluntarily assume full responsibility for any and all risks associated with my participation and the participation of my child(ren) and any guests I bring, including the risk of personal injury, permanent disability, or death. I further acknowledge that participation is voluntary, and I agree that Danville Discovery Camp’s permission to allow such participation is sufficient consideration for this Agreement.

2. Waiver and Release of Liability

In consideration of my child(ren) being permitted to participate in Danville Discovery Camp, I fully and forever waive, release, discharge, and hold harmless Danville Discovery Camp, its owners, Todd and Jocelyn Goforth, employees, agents, volunteers, representatives, affiliates, successors, assigns, contractors, and the owners of any premises used for camp activities (collectively, the “Released Parties”) from and against any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, anticipated or unanticipated, arising out of or related to participation in Danville Discovery Camp. This release expressly includes claims arising out of ordinary negligence by any Released Party. This waiver does not release liability for gross negligence, reckless conduct, or intentional acts to the extent prohibited by law.

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees and court costs) arising out of or related to:

My child(ren)’s participation in Danville Discovery Camp;

The participation of any guest or invitee I bring;

Any breach of this Agreement by me or those for whom I am legally responsible.

This obligation to indemnify extends to claims brought by third parties, other participants, or governmental entities.

4. Medical Treatment Authorization

In the event of a medical emergency, I authorize Danville Discovery Camp and its representatives to obtain medical care for my child(ren) as deemed necessary. I agree to assume full financial responsibility for any medical treatment, ambulance transport, or related expenses incurred.

5. Media Release

I grant Danville Discovery Camp the unrestricted and irrevocable right to photograph, record, film, or otherwise capture images or likenesses of me and/or my child(ren) (the “Photographs”) and to use, reproduce, display, and distribute these Photographs in any and all media now known or hereafter developed, including but not limited to print, internet, promotional materials, social media, or advertising.

I waive any right to royalties or compensation arising from the use of such Photographs and release the Released Parties from any claims arising out of such use. I understand that the Photographs may be altered, combined with other media, or used at the discretion of Danville Discovery Camp.

6. Independent Contractors and Venue Release

I acknowledge that Danville Discovery Camp may contract with third-party vendors, including but not limited to food trucks, entertainers, or other service providers, who operate as independent contractors. I release and hold harmless these vendors and their agents from any and all claims arising from their services.

I further acknowledge that camp activities may be held at venues not owned or operated by Danville Discovery Camp. I release and hold harmless the venue owners, managers, employees, and agents from any and all claims, demands, or liabilities arising out of or related to my or my child(ren)’s participation at these locations.

7. Governing Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of California. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I acknowledge that I have had the opportunity to seek legal counsel regarding this Agreement if I so choose. I further acknowledge that I am not relying on any oral representations, statements, or inducements other than those contained herein.

8. Electronic Consent and Acknowledgment

By checking the box below, I acknowledge that I have read this Agreement carefully and understand its contents. I understand that checking the box constitutes my electronic signature, which is legally binding under applicable state and federal law.

I further acknowledge that if I do not agree to the terms of this Agreement, I will not check the box and will not allow my child(ren) to participate in Danville Discovery Camp.
